Since October 1, the Decree-Law 310 of 2013, which modifies the Cuban law system, has come into effect, due to the need to update the Law Code according to the transformations of the country.
Among the main goals is to get greater affectivity and efficiency in the prevention and fighting against crime, and provide with justice, those who have to deal with the law processes.
During the Round Table TV program, the deputy general attorney of the Cuban Republic, Rafael Pino; the deputy president of the Popular Supreme Court, Oscar Silvera, and the second head of the Direction of General Criminal Research, Felix Alberto Llanes gave details of the new legislation.
The new law widens the processes in the municipal courts and extends it up to 3 years the possibility of deprivation of freedom without getting a hearing.
About the confiscation of properties
Another decree that has come to effect in Cuba last August is the number 313, about the procedures to follow on properties that are confiscated in legal processes and the administrative confiscation.
They explained in the program that disposition says the organisms from the Central Administration of the State and the entities responsible with the warehousing, conservation and disposition of such confiscations.
It also organizes those procedures in view to avoid long stays of the properties confiscated, and it establishes that the incomes coming from the marketing of the properties confiscated will be paid to the State’s Budget.
The success of the new Decree will be on the rational behaviour of the forces from the Ministry of Interior – the only one that acts as warehouse- once the properties, which are directly related to the crime and under investigation, are confiscated.
